Goidel & Siegel won a 2 million-dollar settlement for an 8 year-old boy struck by a van. The incident occurred on a path in Red Hook Park, Brooklyn. The boy sustained a fracture of the distal portion of one leg’s femur. He underwent the insertion of percutaneous pins, surgical removal of the pins and the application of an external fixation device. He also underwent about one year of physical therapy.

His mother sued the van’s driver and the van’s owner, the City of New York. The boy and his mother alleged the driver was negligent in the operation of his vehicle and that the city was vicariously liable for the driver’s actions.

The construction worker whose chest was slashed open in Friday’s deadly Upper East Side crane collapse is already on his feet, family and friends say.

Alexis “Andy” Simeone, a 31-year-old carpenter injured in the Friday accident that killed two fellow hardhats, spent yesterday visiting doctors and running errands, his family said. He was discharged from the hospital Sunday.

News of Simeone’s recovery comes as questions swirl around the last inspector to sign off on the crane – and as City Hall scrambled to put the finishing touches on a proposed overhaul of construction-safety guidelines.

“He’s lucky, he’s really lucky to be alive,” Simeone’s sister Emma told The Post from Grenada, where he grew up. “He said he didn’t know what hit him.”

Simeone, a married father of a 1-year-old daughter, was working inside the building to be known as The Azure on 335 E. 91st Street when the crane collapsed, taking him with it, according to his sister.

“The puncture was on his right side. Had it been on his left side, near his heart, he would have been gone,” said Brownsville neighbor and family friend John Stafford, 51.

Yesterday, Department of Buildings inspector Patrick McGarrigle, who checked the crane a week before the accident and reported nothing amiss, declined comment outside his East Brunswick, NJ, home.

“I can’t talk to you,” he said when asked about reports the crane may have had a faulty turntable connected to the cab and shoddy welds.

Meanwhile, construction worker Houssain Mosharrf , 52, died yesterday in a four-story fall from a scaffolding at a building at 789 St. Marks Ave. in Brooklyn.

Millions of people every day depend on subways and mass transportation in our cities as an economical and effective form of transportation. These people are depending on the transit authority to get them to where they are going safely. Unfortunately this doesn’t always happen. Subway accidents and derailments cause serious injuries and sometimes even death. Train accidents cause thousands of injuries and hundreds of deaths every single year. If you or a loved one has been injured in such an accident you need to seek professional advice immediately!

The main reasons for subway derailment and accidents are:
1. Human error
2. Defective parts that cause brake failures
3. Careless contractors who leave tools on the tracks

With the constant heavy increase in population in the United States, the mass transit systems are put under a great deal more stress because they are being used more than ever before. Because of the great increase in subway system users, there has in turn been a clear increase in accidents as well. The main majority of subway accidents in New York City are the result of preventable human error and defective equipment.

Some of the most common causes of subway accidents in New York City:
• Slips and falls at the station
• Driver error
• Failure of the Subway train
• Subway track and infrastructure problems
• Collisions with other trains
• Derailment
• Chemical spills

Regardless of if you ride the train daily or if it’s your first time, there are a number of other subway hazards you should also be aware of:
• Vandalism
• Robbery
• Assault
• Rape
• Turn style injury
• Being electrified by the tracks
• Subway door injury

In the unfortunate event that you are injured in a subway related accident there are a few things you need to do:

1. In New York the Transit Authority is responsible for the maintenance and upkeep of the subway system. Making them legally responsible for any injuries subway riders may suffer. This means it’s important for you to note your surroundings and if your injury has been caused by negligence. For example, recently there have been many injuries because of the large gap between the train and the platform at New York City and Long Island train stations. If this was the cause of your injury, note if the gap was clearly marked. Were there signs warning you to watch your step? Were they in clear view? Was the area lit well enough? This is a prime example of why it’s a good idea to carry a camera to photograph these surroundings. Your lawyer will need strong evidence to prove your case.

2. Be sure to keep a clear, organized, and ongoing record of any medical treatments you’ve endured, insurance papers, records of lost wages and any and all financial burdens this accident has caused you.

Some of the things you can be compensated for in a personal injury claim include:
a. Pain and suffering
b. Medical expenses for the past and for the future
c. Loss of past and future income
d. Damage to any personal property (as in a laptop broken in the accident)
e. Assistance for the future
f. Compensation for psychological damage
